Acceptable Use Policy
Last updated: August 4, 2026
This policy applies to every message sent through SMS Pulse and is part of the Terms of Service. Its purpose is simple: only message people who asked to hear from you, and never send anything illegal, deceptive or harmful. Violations can lead to immediate suspension or termination without refund.
1. Consent comes first
- Only send messages to recipients for whom you have a valid legal basis - including prior express written consent where the law requires it (for example under the U.S. TCPA for marketing texts).
- Uploaded contact lists must be yours and consent-based. Purchased, rented, traded, harvested or scraped lists are strictly prohibited.
- Keep proof of consent. We may ask for it and pause sending until you provide it.
2. Respect opt-outs
- Marketing messages sent through the service carry an opt-out mechanism. Do not remove, hide or circumvent it.
- An opt-out is permanent for that number and is enforced automatically across your flows. Honor opt-out requests received through any other channel as well.
- Do not re-add opted-out numbers through new lists or new stores.
3. Prohibited content
Never use the service to send messages that contain, promote or link to:
- Illegal products, services or activities in the recipient's jurisdiction.
- Content restricted by carrier rules, including sexually explicit content, hate or harassment, and the promotion of alcohol, firearms, tobacco, vaping or cannabis where restricted, gambling, or illicit substances.
- Fraud, phishing, malware, deceptive prizes, "get rich quick" schemes, or third-party lead generation.
- Misleading sender identity - your sender name must identify your store truthfully.
- Content that infringes intellectual-property or privacy rights.
4. Sending practices
- Identify yourself in every marketing message.
- Respect reasonable frequency; repeated messaging of unengaged recipients is abuse.
- Respect quiet hours where required by the recipient's local law.
- Do not use the service to message emergency numbers, shortcodes or machine-to-machine numbers.
5. The law applies
You must comply with all laws applicable to you and to your recipients, including without limitation the TCPA and CTIA Messaging Principles (US), GDPR and ePrivacy rules (EU/EEA), CASL (Canada) and their equivalents elsewhere. Where this policy and the law differ, the stricter rule applies.
6. Enforcement
- We monitor aggregate sending signals (failure rates, opt-out spikes, carrier complaints) and may review message content when investigating abuse.
- We may refuse, throttle, suspend or terminate sending - or the entire account - immediately and without refund when this policy is violated or when carriers, gateways or authorities require it.
- You remain fully responsible and liable for messages sent from your account (see Sections 6 and 7 of the Terms).
7. Report abuse
Received spam or abuse from a store using SMS Pulse? Report it to info@smspulse.io and we will investigate.
